This Privacy Policy describes how Apex Ecommerce LLC, doing business as JCKED ("JCKED," "we," "us," or "our"), collects, uses, and discloses your personal information when you visit, use, or make a purchase or other transaction using our store, website, and related content, features, tools, products, and services (the "Services"), or otherwise communicate with us. Our online storefront is powered by Shopify; certain purchases, subscriptions, and checkout flows may be processed through additional third-party checkout, subscription, payment, and advertising tools described below.

For the purpose of applicable data protection laws, Apex Ecommerce LLC is the data controller of your personal information. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.

  • Financial information — credit/debit card and financial account numbers, payment card information, transaction details, form of payment, and payment confirmation.

  • Communications — information you include when you contact us, such as a support inquiry, and your SMS/text marketing consent and preferences.

  • Program and wellness information (if you participate in a JCKED program or community). If you join a program such as the JCKED 100-Day Shred or use related tools, we may collect information you choose to provide, such as age, weight, fitness goals, and progress inputs. We do not require you to share health information, and we ask that you do not submit medical records or diagnoses through the Services. See Sensitive & Consumer Health Data below.

Sources of Personal Information

  • Directly from you — when you create an account, use the Services, communicate with us, or otherwise provide your information.
  • Automatically through the Services — from your device when you use our products or visit our websites, and through cookies, pixels, SDKs, and similar technologies.
  • From our service providers — when we engage them to enable technology or process information on our behalf.
  • From our partners or other third parties.

How We Use Your Personal Information

  • Provide, tailor, and improve the Services — to perform our contract with you, process payments, fulfill and manage orders, returns, exchanges, and subscriptions, maintain your account, arrange shipping, enable reviews, and customize and improve your experience.
  • Marketing and advertising — to send marketing and promotional communications by email, text message, or postal mail, and to show you online advertisements on the Services and on other websites and platforms, including based on your prior activity.   • Security and fraud prevention — to authenticate your account, provide a secure payment and shopping experience, and detect, investigate, or act on possible fraudulent, illegal, unsafe, or malicious activity.

  • Legal reasons — to comply with applicable law or valid legal process, and to enforce or investigate potential violations of our terms or policies.

How We Disclose Personal Information

  • Service providers who perform services on our behalf (e.g., IT, payment processing, off-platform checkout and subscription management, data analytics, customer support, cloud storage, fulfillment, and shipping).
  • Advertising and marketing partners to provide marketing services and advertise to you (see the section below).
  • At your direction or with your consent, such as to ship you products or through your use of social media widgets or login integrations.
  • Our affiliates or others within our corporate group.

Advertising, Analytics & Sharing with Ad Platforms

We use cookies, pixels, software development kits (SDKs), and server-side integrations (collectively, "advertising technologies") to measure and improve our advertising and to deliver advertising tailored to your interests. As part of this, we share certain personal information — which may include identifiers such as your email address or phone number (often in hashed form), IP address, device and browser information, and information about your activity and purchases — with third-party advertising and analytics platforms, including Meta (Facebook/Instagram), Snapchat, and Google. These platforms may use this information to measure conversions, build audiences, and show you and others ads across their services and partner networks, in accordance with their own privacy policies.

Some of this activity may be considered a "sale" or "sharing" of personal information for targeted advertising under certain U.S. state privacy laws. You have the right to opt out of this sharing — see Your Rights and Choices below for how to opt out, including via the Global Privacy Control signal.

Relationship with Shopify

Our online storefront is hosted by Shopify, which collects and processes personal information about your access to and use of the storefront in order to provide and improve those services. Information you submit may be transmitted to and shared with Shopify and third parties that may be located in countries other than where you reside. Where Shopify processes your personal information for its own purposes, Shopify is responsible for that processing, including responding to requests to exercise your rights over it. Where your purchase is completed through our off-platform checkout, that transaction may be processed outside Shopify by our checkout and payment providers.

Third-Party Websites and Links

The Services may link to websites or platforms operated by third parties. If you follow such links, review their privacy and security policies and terms. We do not guarantee and are not responsible for the privacy or security of those sites. Our inclusion of links does not imply endorsement.

Children's Data

The Services are not intended for children, and we do not knowingly collect personal information about children under the age of majority in your jurisdiction (and our products are intended for adults 18+). If you are a parent or guardian of a child who has provided us with personal information, contact us using the details below to request deletion. As of the effective date, we do not have actual knowledge that we "share" or "sell" the personal information of individuals under 16 years of age.

Sensitive & Consumer Health Data

Some information related to our wellness programs (such as fitness goals or progress inputs) may be considered sensitive or "consumer health data" under certain laws. We do not sell consumer health data, and we do not use it to serve you targeted advertising based on a health condition. We ask that you do not submit medical diagnoses, treatment records, or other sensitive health records through the Services. Where required by applicable law, we will obtain your consent before collecting consumer health data and will not share it without the authorization that the law requires. Security and Retention

No security measures are perfect or impenetrable, and we cannot guarantee "perfect security." Information you send to us may not be secure while in transit, so we recommend you do not use unsecure channels to communicate sensitive or confidential information. How long we retain your personal information depends on factors such as whether we need it to maintain your account, provide the Services, comply with legal obligations, resolve disputes, or enforce our contracts and policies.

Your Rights and Choices

Depending on where you live, you may have some or all of the following rights regarding your personal information. These rights are not absolute and may apply only in certain circumstances; in some cases we may decline a request as permitted by law.

  • Right to Access / Know — request access to the personal information we hold about you.
  • Right to Delete — request that we delete personal information we maintain about you.
  • Right to Correct — request correction of inaccurate personal information.
  • Right of Portability — receive a copy of your personal information and, in certain cases, have it transferred to a third party.
  • Right to Opt Out of Sale/Sharing and Targeted Advertising — opt out of the "sale" or "sharing" of your personal information and of processing for targeted advertising. To opt out, email info@jcked.com with the subject line "Do Not Sell or Share My Personal Information," or use any opt-out link or preference control we provide on the Services. If you visit our website with the Global Privacy Control (GPC) signal enabled, we will, where applicable, treat it as a request to opt out for that browser and device.   • Managing Communication Preferences — opt out of promotional emails via the unsubscribe link in our emails, and opt out of marketing texts by replying STOP. We may still send non-promotional messages about your account or orders. We will not share your Text message opt-in or consent status with any third party for purposes unrelated to providing the messaging service. We may share this data with vendors who help us deliver text messages, including platform providers and phone companies.

If you reside in the UK or European Economic Area, subject to local-law exceptions, you may also have the right to object to or restrict processing and to withdraw consent where we rely on it (without affecting the lawfulness of prior processing).

We may need to verify your identity, and we will respond within the time required by applicable law. You may use an authorized agent, subject to proof of authorization and identity verification.

Complaints

For the EEA, you can find your supervisory authority through the European Data Protection Board.

International Transfers

We may transfer, store, and process your personal information outside the country you live in. If we transfer personal information out of the European Economic Area or the United Kingdom, we rely on recognized transfer mechanisms such as the European Commission's Standard Contractual Clauses (or the UK equivalent), unless the transfer is to a country determined to provide an adequate level of protection.
